(2) You will only have one Talent Mart account, which must be in your real name;

(3) You will be restricted or block by Talent Mart from using the Services if discovered that you have more than one account;

(4) You will not Upload or post contents that are not originally yours as this is not permitted and will disqualify you from using our services as well as receiving the attached benefit(s);

(5) You will not Create an account with false information as it will amount to a violation of our terms, including accounts registered on behalf of others or persons under the age of 18 except by the child's parent or guardian;

(6) You will not upload, post or share an impure, harmful, life-threatening, unpleasant, hate, porn and their like content.

(7) You will not upload, post or share contents that criticise or attack any individual, group, gender, tribe, religion or government of any nation.

Bridging any of the above will disqualify you from using our service as well as receiving the attached benefits.

 

YOUR ACCOUNT

It is your responsibility to keep your password, PIN/codes and other private information secret.

You must not share an account with anyone else and must follow our policies and the law. Users are account holders.

All Partners and Staff account is known as CM Account, that means ‘Closely Monitored Account’. Thus, any user following any Partner or Staff or that followed by any Partner or Staff is known and Marked as CM Account.

 

RESTRICTED ACTIVITIES

You must not use Talent Mart Social Network in connection with any product, service, transaction or activity that:

1). Violates any law or government regulation, or promotes or facilitates such violation by third parties including customers;

2). Violates any rule or regulation of any electronic funds transfer network;

3). Is fraudulent, deceptive, unfair or predatory;

4). Causes or threatens reputational damage to us;

5). Involves any of the business categories listed under “Certain Business Categories” below; or

6). Results in or creates a significant risk of chargebacks, penalties, damages or other harm or liability.

a. CERTAIN BUSINESS CATEGORIES

You must not use Talent Mart Social Network in connection with any product, service, transaction or activity that involve:

1). The Prohibition List of Customs Service of any country.

2). Banned narcotics, steroids, certain controlled substances or other products that present a risk to consumer's safety;

3). Blood, bodily fluids or body parts;

4). Counterfeit items;

5). Illegal drugs and drug paraphernalia;

6). fireworks, destructive devices and explosives;

7). Secret government documents or government financial records;

8). lottery tickets, sweepstakes entries or slot machines without the required license;

9). offensive material or hate speech or items that promote hate, violence, racial intolerance, or the financial exploitation of any kind;

10). Military or police badges or uniforms;

11). chemicals;

12). recalled items;

13). prohibited services;

14). unlicensed financial services, stocks or other securities;

15). stolen property;

16). items that infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the laws of any jurisdiction;

17). sales of currency without Bureau De Change license, certain cryptocurrency operators;

18). obscene material or pornography;

19). certain sexually oriented materials or services;

20). firearms, firearm parts or accessories, ammunition, weapons or knives; or

21). any product or service that is illegal or marketed or sold in such a way as to create liability to Talent Mart Social Network.

 

b. RELATE TO TRANSACTIONS THAT

1). show the personal information of third parties in violation of applicable law;

2). violate the Guidelines on International Money Transfer Services;

3). support pyramid or Ponzi schemes, matrix programs, other "get rich quick" schemes or certain multi-level marketing programs;

4). are used as covers for money laundering and the financing of terrorism.

5). pertain to ammunitions and arms; and

6). involve gambling, gaming and/or any other activity with an entry fee and a prize, including, but not limited to casino games, sports betting, horse or greyhound racing, lottery tickets, other ventures that facilitate gambling, games of skill (whether or not it is legally defined as a lottery) and sweepstakes unless the operator has obtained prior approval from Talent Mart Social Network and the operator and customers are located exclusively in jurisdictions where such activities are permitted by law.

 

 ACTIONS BY TALENT MART SOCIAL NETWORK

If, in our sole discretion, we believe that you may have engaged in any violation of this Agreement, we may (with or without notice to you) take such actions as we deem appropriate to mitigate risk to Talent Mart Social Network and any impacted third parties and to ensure compliance with this Agreement. Such actions may include, without limitation:

1). Blocking the settlement or completion of one or more transaction;

2). Suspending, restricting or terminating your access to and use of Talent Mart Social Network’s Services;

3). Terminating our business relationship with you, including termination without liability to Talent Mart Social Network of any payment service agreement between you and Talent Mart Social Network;

4). Taking legal action against you;

5). Contacting and disclosing information related to such violations to: (i) any bank or Card Network involved with your business or transactions, (ii) law enforcement or regulatory agencies, and (iii) other third parties that may have been impacted by such violations; or (iv) Assessing against you any fees, penalties, assessments or expenses (including reasonable attorneys’ fees) that we may incur as a result of such violations, which you agree to pay promptly upon notice.

 

REGISTRATION

To create an account, you need to provide data including your name, gender, e-mail address, mobile number, country, city and a password. If you register as content creator, you will need to vote for yourself first to activate your page. You create your Talent Mart Social Network profile (a complete profile helps you get the most from our Services).

 

OUTLINE

You have choices about the information on your profile, such as your education, work experience, skills, photo, city or area and endorsements. You don't have to provide additional information on your profile; however, profile information helps you to get more from our Services, including helping other users to vote for you. It's your choice whether to include sensitive information on your profile and to make that sensitive information public. Please do not post or add personal data to your profile that you would not want to be publicly available.

 

POSTING AND UPLOADING

We collect personal data from you when you provide, post or upload it to our Services, such as when you fill out a form. You don't have to post or upload personal data; though if you don't, it may limit your ability to grow and engage with your network over our Services.

 

MODIFICATION

We may make changes to the Contract. We may modify this Contract, our Privacy Policy from time to time. If we make material changes to it, we will provide you notice through our Services, or by other means, to provide you the opportunity to review the changes before they become effective. We agree that changes cannot be retroactive. If you object to any changes, you may close your account. CONTENT AND NEWS

You and others may post content that includes information about you (as part of articles, posts, comments, pictures, videos) on our Services. We will contact you through email, mobile phone, notices posted on our websites or apps, messages to your Talent Mart inbox, and other ways through our Services, including text messages and push notifications. We will send you messages about the availability of our Services, security, or other service-related issues. We also send messages about how to use our Services, network updates, reminders, and promotional messages from us and our partners.

You may change your communication preferences at any time. Please be aware that you cannot opt out of receiving service messages from us, including security and legal notices.

We also enable communications between you and others through our Services, including for example invitations, InMail, groups and messages between connections.

 

ADVERTISING

We serve you tailored ads both on and off our Services. We offer you choices regarding personalized ads, but you cannot opt-out of seeing other ads. We target (and measure the performance of) ads to Users, Visitors and others both on and off our Services directly or through a variety of partners, using the following data, whether separately or combined:

We will show you ads called sponsored content which look similar to non-sponsored content, except that they are labelled as advertising (e.g., as “ad” or “sponsored”). If you take a social action (such as comment or share) on these ads, your action is associated with your name and viewable by others, including the advertiser. Subject to your settings, if you take a social action on the Talent Mart Services, that action may be mentioned with related ads.

 

AD CHOICES

We adhere to self-regulatory principles for interest-based advertising and participate in industry opt-outs from such ads. This does not opt you out of receiving advertising; you will continue to get other ads by advertisers not listed with these self-regulatory tools. You can also opt-out specifically from our uses of certain categories of data to show you more relevant ads.

 

INFO TO AD PROVIDERS

We do not share your personal data with any third-party advertisers or ad networks except for: (i) hashed IDs or device identifiers (to the extent they are personal data in some countries); (ii) with your separate permission (e.g., in a lead generation form) or (iii) data already visible to any users of the Services (e.g., profile).   • When you share an article or a post (e.g., an update, image, video or article) publicly it can be viewed by everyone and re-shared anywhere (subject to your settings).
  • Content Creators/Users or Exhibitors will be able to find and see your publicly-shared contents, including your name (and photo if you have provided one).
  • In a group, posts are visible to others in the group. Your membership in groups is public and part of your profile, but you can change visibility in your settings.
  • Any information you share through companies' or other organizations' pages on our Services will be viewable by it and others who visit those pages.
  • When you follow a person or organization, you are visible to others and that “page owner” as a follower.
  • We let senders know when you act on their message, subject to your settings where applicable.
  • Subject to your settings, we let Users know when you view their profile.
  • When you vote, share or comment on another's content (including ads), others will be able to view these “social actions” and associate it with you (e.g., your name, profile and photo if you provided it).
  • Voters can see how you rise with the votes they provided for you and related information.

We will retain de-personalized information after your account has been closed.

Information you have shared with others (e.g., through InMail, updates or group posts) will remain visible after you close your account or delete the information from your own profile or mailbox, and we do not control data that other users have copied out of our Services. Groups content and ratings or review content associated with closed accounts will show an unknown user as the source. Your profile may continue to be displayed in the services of others (e.g., search engine results) until they refresh their cache.

If you subscribe or buy any of our paid Services (Premium Services), you agree to pay us the applicable fees and taxes and additional terms specific to the paid Services. Failure to pay these fees will result in the termination of your paid Services.

Also, you agree that:

* Your purchase may be subject to foreign exchange fees or differences in prices based on location (e.g. exchange rates).

* We may store and continue billing your payment method even after it has expired, to avoid interruptions in your Services and to use to pay other Services you may buy.

* If you purchase a subscription, your payment method automatically will be charged at the start of each subscription period for the fees and taxes applicable to that period. To avoid future charges, cancel before the renewal date.

RIGHTS AND LIMITS

Your License to Talent Mart Social Network

You own all of the content, feedback and personal information you provide to us, but you also grant us a non-exclusive license to it. We'll honour the choices you make about who gets to see your information and content, including how it can be used for ads.

As between you and Talent Mart Social Network, you own the content and information that you submit or post to the Services, and you are only granting Talent Mart and our affiliates the following non-exclusive license:

A worldwide, transferable and sub-licensable right to use, copy, modify, distribute, publish and process, information and content that you provide through our Services and the services of others, without any further consent, notice and/or compensation to you or others. These rights are limited in the following ways:

1.         You can end this license for specific content by deleting such content from the Services, or generally by closing your account, except (a) to the extent you shared it with others as part of the Service and they copied, re-shared it or stored it and (b) for the reasonable time it takes to remove from backup and other systems.

2.         We will not include your content in advertisements for the products and services of third parties to others without your separate consent (including sponsored content). However, we have the right, without payment to you or others, to serve ads near your content and information, and your social actions may be visible and included with ads, as noted in the Privacy Policy. If you use a Service feature, we may mention that with your name, video or photo to promote that feature within our Services, subject to your settings.

3.         We will get your consent if we want to give others the right to publish your content beyond the Services. By submitting suggestions or other feedback regarding our Services to Talent Mart, you agree that Talent Mart can use and share (but does not have to) such feedback for any purpose without compensation to you. You promise to only provide information and content that you have the right to share, and that your Talent Mart profile will be truthful.

You agree to only provide content or information that does not violate the law nor anyone's rights (including intellectual property rights). You also agree that your profile information will be truthful. Talent Mart may be required by law to remove certain information or content in certain countries.

 

SERVICE AVAILABILITY

We may change or end any Service or modify our prices prospectively. We may change, suspend or discontinue any of our Services. We may also modify our prices effective prospectively upon reasonable notice to the extent allowed under the law.

We don't promise to store or keep showing any information and content that you've posted. Talent Mart is not a storage service. You agree that we have no obligation to store, maintain or provide you a copy of any content or information that you or others provide, except to the extent required by applicable law and as noted in our Privacy Policy.

 

OTHER CONTENT, SITES AND APPS

Your use of others’ contents and information posted on our Services, is at your own risk. Others may offer their own products and services through our Services, and we aren't responsible for those third-party activities.

By using the Services, you may encounter content or information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive or otherwise harmful. Talent Mart generally does not review content provided by our users or others. You agree that we are not responsible for others' (including other users') content or information. We cannot always prevent this misuse of our Services, and you agree that we are not responsible for any such misuse. You also acknowledge the risk that you or your organization may be mistakenly associated with content about others when we let connections and followers know you or your organization were mentioned in the news. Users have choices about this feature.

 

LIMITS

We have the right to limit how your connection and interaction on our Services.

Talent Mart reserves the right to limit your use of the Services, including the number of your connections and your ability to contact other users. Talent Mart reserves the right to restrict, suspend, or terminate your account if you breach this Contract or the law or are misusing the Services (e.g., violating any of the Dos and Don'ts or Policies).

 

INTELLECTUAL PROPERTY RIGHTS

We're providing you notice about our intellectual property rights. Talent Mart reserves all of its intellectual property rights in the Services. Trademarks and logos used in connection with the Services are the trademarks of their respective owners. Talent Mart, and “in” logos and other Talent Mart trademarks, service marks, videos, graphics and logos used for our Services are trademarks or registered trademarks of Talent Mart.

 

AUTOMATED PROCESSING

We use data and information about you to make relevant suggestions to you and others.

We use the information and data that you provide and that we have about users to make recommendations for connections, campaign for votes, content and features that may be useful to you. For example, we use data and information about you to recommend contract to you. Keeping your profile accurate and up to date helps us to make these recommendations more accurate and relevant.

 

EXCLUSION OF LIABILITY

These are the limits of legal liability we may have to you.

To the fullest extent permitted by law (and unless Talent Mart has entered into a separate written agreement that overrides this contract), Talent Mart, including its affiliates, will not be liable in connection with this contract for lost profits or lost business opportunities, reputation (e.g., offensive or defamatory statements), loss of data (e.g., down time or loss, use of, or changes to, your information or content) or any indirect, incidental, consequential, special or punitive damages.

Talent Mart Social Network and its affiliates will not be liable to you in connection with this contract for any amount that exceeds the total fees paid or payable by you to Talent Mart for the services during the term of this contract.

 

TERMINATION

We can each end this Contract, but some rights and obligations survive.

Both you and Talent Mart Social Network may terminate this Contract at any time with notice to the other. On termination, you lose the right to access or use the Services.

The following shall survive termination:

* Our rights to use and disclose your feedback;

* Users and/or Visitors' rights to further re-share content and information you shared through the Services;

* Any amounts owed by either party prior to termination remain owed after termination.

 

TALENT MART SOCIAL NETWORK “DOS AND DON'TS”

  1. DOs

This list of “Dos and Don'ts” along with our limit of what you can and cannot do on our Services.

You agree that you will:

1.         Comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, tax laws, and regulatory requirements;

2.         Provide accurate information to us and keep it updated;

3.         Use your real name on your profile; and

4.         Use the Services in a professional manner.

 

2. DON'TS

You agree that you will not:

1.         Create a false identity on Talent Mart Social Network, misrepresent your identity, create a user profile for anyone other than yourself (a real person), or use or attempt to use another's account;

2.         Develop, support or use software, devices, scripts, robots or any other means or processes (including crawlers, browser plugins and add-ons or any other technology) to scrape the Services or otherwise copy profiles and other data from the Services;

3.         Override any security feature or bypass or circumvent any access controls or use limits of the Service (such as caps on keyword searches or profile views);

4.         Copy, use, disclose or distribute any information obtained from the Services, whether directly or through third parties (such as search engines), without the consent of Talent Mart;

5.         Disclose information that you do not have the consent to disclose (such as confidential information of others);

6.         Violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets or other proprietary rights. For example, do not copy or distribute (except through the available sharing functionality) the posts or other content of others without their permission, which they may give by posting under a Creative Commons license;

7.         Violate the intellectual property or other rights of Talent Mart, including, without limitation, (i) copying or distributing our learning videos or other materials or (ii) copying or distributing our technology, unless it is released under open source licenses; (iii) using the word “Talent Mart” or our logos in any business name, e-mail, or URL except as provided in the Brand Guidelines;

8.         Post anything that contains software viruses, worms, or any other harmful code;

9.         Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Services or any related technology that is not open source;

10.       Imply or state that you are affiliated with or endorsed by Talent Mart without our express consent (e.g., representing yourself as an accredited Talent Mart, staff, director, agent, trainer, etc.);

11.       Rent, lease, loan, trade, sell/re-sell or otherwise monetize the Services or related data or access to the same, without Talent Mart Social Network's consent;

12.       Deep-link to our Services for any purpose other than to promote your profile or a Group on our Services, without Talent Mart Social Network’s consent;

13.       Use bots or other automated methods to access the Services, add or download contacts, send or redirect messages;

14.       Monitor the Services' availability, performance or functionality for any competitive purpose;

15.       Engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Services;

16.       Overlay or otherwise modify the Services or their appearance (such as by inserting elements into the Services or removing, covering, or obscuring an advertisement included on the Services);

17.       Interfere with the operation of, or place an unreasonable load on, the Services (e.g., spam, denial of service attack, viruses, gaming algorithms); and/or

18.       Violate the Policies or any additional terms concerning a specific Service that are provided when you sign up for or start using such Service.

 

COMPLAINTS REGARDING CONTENT

To the extent that applicable local law prevents certain disputes from being resolved in a federal court, then you can file those disputes in your local courts. Likewise, if applicable local law prevents your local court from applying federal law to resolve these disputes, then these disputes will be governed by the applicable local laws of your country, state, or other place of residence.

COPYRIGHT POLICY

Talent Mart respects the intellectual property rights of others and desires to provide a platform with no content that violates those rights.

Our User Agreement requires that information posted by users be accurate, lawful and not in violation of the rights of third parties. To promote these objectives, Talent Mart Social Network provides a process for submission of complaints concerning contents posted by our users. Our policy and procedures are described and/or referenced in the sections that follow.

Please note that whether or not we disable access to or remove content, Talent Mart Social Network may make a good faith attempt to forward the written notification, including the complainant's contact information, to the User who posted the content and/or take other reasonable steps to notify the User that Talent Mart Social Network has received notice of an alleged violation of intellectual property rights or other content violation. It is also our policy, in appropriate circumstances and in our discretion, to disable and/or terminate the accounts of Users, or groups as the case may be, who infringe or repeatedly infringe the rights of others or otherwise post unlawful contents.

Please note that any notice or counter-notice you submit must be truthful and must be submitted under Penalty of Perjury. A false notice or counter-notice may give rise to personal liability. You may therefore want to seek the advice of legal counsel before submitting a notice or a counter-notice.

 

USERS PROFILE

Your profile is fully visible to all Users and Visitors of our Services. Subject to your settings, it can also be visible to others on or off of our Services (e.g., Visitors to our Services or users of third- party search engines).

As detailed in our Policies and Terms, your settings, (degree of connection, fraud detection, marketing and development). The Organizer will have access to your information as reasonably necessary.

 

MISCELLANEOUS

  • You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Assigning or sub-contracting any of your rights or obligations under this Agreement to any third party is prohibited. We reserve the right to transfer, assign or sub-contract the benefit of the whole or part of any right or obligation under these Terms of Use to any third party.
  • If any portion of this Privacy Policy is held by any court or tribunal to be invalid or unenforceable, either in whole or in part, then that part shall be severed from this Policy and shall not affect the validity or enforceability of any other part in this Policy.
  • By accessing or using Talent Mart Social Network, you agree to comply with the terms and conditions of this Acceptable Use Policy.
